§ 1-213. Findings of fact

  • (a) The Board of County Commissioners of Broward County, Florida, finds, determines and declares as follows: § 768.28, F.S., as amended, recognizes a waiver of sovereign immunity by political subdivisions in tort actions, and it also limits the liability of political subdivisions for tort claims such that Broward County shall not be liable to pay a tort claim or a judgment by any one person which exceeds the sum of one hundred thousand dollars ($100,000.00), or any claim or judgment, or portions thereof, which, when totaled with all other claims or judgments paid by Broward County arising out of the same incident or occurrence, exceeds the sum of two hundred thousand dollars ($200,000.00).

    (b) In view of the statutory limitations set forth above, and to serve the citizens of Broward County in the efficient, timely and orderly disposition and settlement of all claims brought against Broward County, it is necessary and a public purpose for the board of county commissioners to create and to maintain a self-insurance fund from which such claims may be paid.
