§ 1-11. Guardianship programs; fee for investigations

  • In implementation of the administrative order of the Chief Judge of the Circuit Court of the Seventeenth Judicial Circuit in and for Broward County, Florida, there is hereby established the following fee to be imposed on prospective and appointed guardians for credit history investigations and criminal background investigations:

    Credit and criminal investigation fee .....$50.00

    The above fee is to be paid to the Clerk of Court, for remittance to Broward County government upon submission of an application requesting appointment as a guardian. The above fee shall be waived if the prospective guardian is declared indigent. No fee shall be imposed on a prospective or appointed guardian who is the spouse or child of the ward. No more than one credit and criminal investigation fee shall be imposed on a prospective guardian where multiple applications relating to multiple wards are submitted concurrently by the same prospective guardian. No investigation need to be performed where an application is submitted within ninety (90) calendar days of the date that an inoffensive investigation was completed on an earlier application. Nevertheless, appointed guardians shall undergo periodic and recurring credit and criminal investigation at least once every calendar year. All appointed guardians shall undergo credit and criminal investigation at the time of the filing of the annual guardianship plan or accounting or both as required by law. Moreover, prospective and appointed guardians shall have a continuing affirmative duty to disclose adverse information relating to their credit and criminal backgrounds.
